Informal Resolution First
Before initiating any formal dispute, you agree to contact us in writing and make a good faith effort to resolve the matter informally. Written notice should be sent to info@backgroundcheckhub.com or by mail to the address below, describing the dispute and the relief you are seeking. We will respond within 30 days.
Binding Arbitration
If the dispute cannot be resolved informally, you and BackgroundCheckHub agree that any claim or dispute arising out of or relating to these Terms or your use of this site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration may be conducted by telephone, online, or written submission at the option of the party seeking relief. Information about the AAA is available at www.adr.org.
Exceptions
Arbitration is not required for:
- Small claims actions of $10,000 or less brought on an individual basis within a small claims court’s jurisdiction.
- Claims for injunctive or other equitable relief related to intellectual property infringement.
Class Action Waiver
You and BackgroundCheckHub agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any class proceeding.
Opt Out
If you are an individual and do not wish to be bound by this arbitration agreement, you may opt out by sending written notice to info@backgroundcheckhub.com within 30 days of first using this site. Opting out does not affect any other provision of these Terms.
Governing Law for Arbitration
This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and survives any termination of these Terms.
12. Governing Law
Except as provided in the arbitration section above, these Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, California.
13. Changes to These Terms of Use
We may update these Terms of Use from time to time. Changes will be posted at this location with an updated effective date. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms.
14. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision does not constitute a waiver.
These Terms constitute the entire agreement between you and BackgroundCheckHub regarding your use of this site.
